click here.] 1. CIS will process I-485 applications before FBI Name Check result
if it has been pending for more than 180 days.
CIS published a memorandum on February 4, 2008 to establish a new policy that,
if an immigrant's application for a residence visa (I-485, et al) has been in the
system for more than 180 days and the only missing piece is a name check by the F.B.I.,
immigration officers will now be allowed to approve the application. The memorandum states
that "in the unlikely event" that the F.B.I. name check turns up negative information about
an immigrant after a residence visa has been granted, the authorities can cancel the visa
and begin deportation proceedings.
2. AILA published NSC I485 transfer policy, which is summarized as the follows.
As previously stated, a transfer of an I-485 is generally allowable, provided that visas
are available, both underlying petitions are approved and there are no adverse factors in
terms of merit, fraud, or other circumstances which might lead to a revocation. The hypothetical
posed in the question of a transfer of an employment-based I-485 from an I-140, to a
family-based I-130 petition, and then back again would generally not be allowed.
According to this policy, if an applicant who is subject to EB2 visa backlog filed both EB1A
and EB2NIW, and the I-485 application is also concurrently filed with EB1A, this applicant may
NOT be able to transfer his I485 to his EB2NIW if his EB1A is denied even his EB2NIW is approved
because, first, the EB1A is not approved, and second, the visa number is NOT available to his EB2NIW.
3. Good news about employment based immigrant visa petitions
a. Citations do help! An EB2NIW filed in late July 2008 was approved without RFE. The applicant
is a Korean national and concurrently filed the I485 application, which is approved concurrently
with the I140. This applicant provided all 298 citations and 95 review citations. The case was
approved without RFE.
b. Media reports about the research group are supportive! We helped a postdoc researcher in
computer science prepared and filed an Eb2NIW in early July 2007. The applicant had 21 journal
and conference papers. In this petition, we emphasized on the media reports about the research
group with which our client has been working, including the news reports published by published
by The New York Times, Daily Trojan, Wired News, etc.. The case was approved without RFE.
4. A good strategy to apply your working visa and your green card: O1 to EB1B: O1 is approved
in 5 days.
We helped a postdoc get an O1 visa to work for a high-tech company in 5 business days. A high-tech
company wants to hire a postdoc in a university to start working immediately. We helped the company
make a strategic plan to apply an O1 first then to apply for an EB1B. O1 is an employment visa that
does not have to wait until April 1st to file and October 1st to start working. Based our prior
experience, we well-documented the petitioner's qualifications, the beneficiary's (the postdoc)
accomplishments and his future research plan. At the time of filing, the beneficiary had 22 journal
papers, 9 conference presentations, 1 pending patent. Because O1 is for alien of extraordinary
ability and CIS approved the case, we expect to file his EB1B shortly based on the approved O1.
5. Visa backlog on EB2 for the Chinese Mainland born progressed almost a year. The priority date for
March 2008 is December 1, 2003. EB2 visa number for the Indian nationals is still unavailable next month.
